SUMMARY

 

It is necessary to vote monies for the continued operation of Council until such time as the Operational Plan 2016-17 is adopted – this is consistent with the 12 May 2016 Proclamation.  It is also necessary to resolve that existing 2015-16 fees and charges will continue until such time as the Fees and Charges for 2016-17, which forms part of the 2016-17 Operational Plan, are adopted. These matters need to be resolved by Council no later than 30 June 2016.

 

 

 

RECOMMENDATION

 

That Council:

 

1.    approve expenditure and vote $39 million for the period from 1 July 2016 until the adoption by the council of the first operational plan for the Inner West Council.

2.    approve the continuation of the 2015-16 adopted fees and charges until the adoption by the council of the first operational plan for the Inner West Council.

 

 

 

 

BACKGROUND

 

Under the Local Government Act 1993, an operational plan (including the budget and fees & charges) is normally required to be adopted by 30 June.  The Proclamation (dated 12 May 2016) amalgamating the former Ashfield, Leichhardt and Marrickville Councils into the Inner West Council, amended this by providing:

 

·    The day by which a new council must have an operational plan is 1 August 2016 (s22).

·    A new council may hold a meeting for the purposes of approving expenditure and voting money for the period from 1 July 2016 until the adoption by the council of the first operational plan for the council (s24).

 

To enable the operations of Council to continue, it is necessary for Council to approve expenditure and vote money for the period from 1 July 2016 until the adoption by the council of the first operational plan for the council.  The amount of $39 million is based on the budgets contained in the draft 2016-17 Operational Plan – being an amount estimated to be sufficient to ensure council’s continued operational and capital activities until the adoption by the council of the 2016-17 Operational Plan.

 

The Chief Financial Officers of the three former councils have been consulted on this matter and have agreed the amount.

 

 

FINANCIAL IMPLICATIONS

Council maintains business as usual.

PUBLIC CONSULTATION

The Inner West Council draft 2016-17 Operational Plan, incorporating budgets and fees & charges, is on public exhibition until 30 June 2016.

 

 

CONCLUSION

For the continuing operations of Council, it is necessary for Council to approve and vote $39 million for the period 1 July 2016 until the adoption by the Council of the first operational plan for the Inner West Council.  To ensure certainty it is also necessary for Council to approve the continuation of the 2015-16 adopted fees and charges until the adoption by the council of the first operational plan for the Inner West Council. The continuation of 2015-16 fees and charges does not in any way affect the setting and levying of any of Council’s 2016-17 fees and charges when the 2016-17 Operational Plan is adopted.
