Subject:         Mayoral Minute: Extension of Outgoing General Manager Contract to Align with Incoming Chief Executive Officer Commencement

Motion:

 

THAT Council extend the employment contract of the current General Manager to

1 March 2019 to enable a handover to the incoming CEO.

 

 

Background

 

Legislative Requirements under the Local Government Act:-

 

Section 336 Filling of vacancy in position of general manager

 

(1)        If a vacancy occurs in the position of general manager, the council must immediately appoint a person under section 334 to the vacant position or appoint a person to act in the vacant position.

 

Council is currently undertaking the recruitment process for a new Chief Executive Officer. It is not envisaged, given the current process timeframes, that a new Chief Executive Officer will commence until at least February 2019, dependent on the successful candidate’s employment contract notice period.

 

As it is a requirement for Council to have a General Manager position occupied, it is appropriate to extend the current contract of the outgoing General Manager to continue in the role and provide a smooth transition for the new Chief Executive Officer. The outgoing General Manger’s contract expires on 12 December 2018 and he has indicated his willingness for the extension and handover to the incoming CEO. His contract term allows for an extension for this period of time.
